catching fish legally that have been snagged?

is it legal according to the odnr to legally catch a fish that has been snagged previously(which has been caught illegally and then released)?

if the odnr were to approach you after a day of fishing in which you have legally caught your fish but has marks on its body that it has been snagged in the past, is it still legal for you to keep that fish??

I suggest when you do catch a legal fish regardless if you think it was foul hooked before that you hold it in plain veiw as you unhook it so the D.N.R. can clearly see it. Even then it is still possable to get a ticket depending on the officer. I have a friend that is going to college in hopes to become a D.N.R. officer and he received a fine for catching a legal fish. He hooked it in the upper lip sideways, and was not on the outside but in the lower part of the upper jaw. I I'm disappointed that he did not fight it in court. This sort of thing does happen while many poachers unhook their walleyes under water and get away with it. I have to convence anglers to not give up on fishing the river quite a few times a year when they think the D.N.R. gives tickets out like this. I always tell them if you think you are in the right, take to court. Our judge will listen to you. I'm not beating up on the D.N.R., in fact I'm a big fan of the D.N.R. but some times they can make a bad call. Several years ago anglers used to get tickets for swapping out smaller fish for bigger ones until I notifed the head law inforcement for district 2 and we got it straithten out. You can swap fish but only on a chain stringer and not on a rope stringer. Make sure you keep the fith fish in your net, then drop one off you stringer, then put your new fish on your stringer. Never release a fish thats not in good shape. If it ends up floating you may recevie a ticket. Need to get back to work, seeya later.

I've also caught legal fish with lures snagged and broken off in there sides, bellies, etc. I just leave them on there and walk out them. I've never been approached by a DNR officer about it and it's happened atleast 4 times I can remember. I have been harassed by other anglers walking out when they see it until I explain the situation.

Yes, They have to prove YOU snagged the fish, but in issuing a ticket the burden is put on you as the subject. (the ball is in your court) Most law enforcement issue a ticket, with an honest belief or personal knowledge that it is the correct thing to do. Others, take a gamble that you will just pay the ticket. How many times have you heard from someone or "just paid the ticket"? I hope the young man trying to be ODNR didn't spoil his chances by "just paying the ticket" On the other hand, that can be a handy strategy if you don't want the "whole truth and nothing but" coming to the surface!

Well i no wardens are human and prone to errors but last year i was fishing the river had snagged 2 walleye released them right away, after about a hour 2 wardens come down and say they saw me snag 2 fish. I said i did but releaseed them right away. He told me he seen me throw them up in the rocks, so they proceeded to look for these fish and when they could not find them they turned into real a**holes about the whole situation. Kind of making a show about the whole situation to the people fishing around, with there macho im the boss attitude.

I am new to this river fishing, but I don't see the big deal about nets. I don't even take a net. If I can grab it then I got it and then if I can't and it gets off the line then that's fine. When I caught my fish last week, I played him out and when he got close I grabbed him and held him up. There was about 6 guys fishing around me and they all nodded and said, "yep, thats a legal fish." No DNR guy could bust me on that deal whether the fish had snag marks from before or not.

I've caught a lot of saugeye this way. Every once in awhile one will get off and it's no big deal. It might be disheartening if I ever lost a state record and I lost a hefty saugeye a few years back but it was just a fish. Not that big of a deal in my book.

I do take a net when I go musky fishing though!!!!
