You don't own to the center of the road. Some sort of government entity owns it, be it the county, state, etc.... We really can't see much from the pictures, but it seems the water is draining into the ditch like it's supposed to. From there, if you don't want it to continue into your yard you need to make your yard higher in that spot. Again, we can't see if that's feasible in those pics, but water is going to follow the path of least resistance. But you've talked to everyone you need to talk to, if it was someone to force into action they would have done it. The EPA likes nothing more than to justify their existence. At this point it seems fairly straight forward that it's your issue. Sucks, but sometimes that's part of ownership.

That is wrong. He stated his deed lists the centerline as the property line so he owns to the centerline. Yours may not be that way and many are not but many still are. The portion within the R/W is subject to use as R/W and likely he can’t build anything permanent in it but he still owns it. Some sort of government entity has responsibility for the R/W but doesn't own the property in it.

He may pay taxes on it, but for all intents and purposes, he doesn’t own it.
